Problems of the concept of euthanasia

Abstract

The term of euthanasia is nowadays used more than appropriate in the debates on end of life decisions. Not only the means rea constituting murder or assisted suicide is often to be subsumed under the euthanasia qualification just because of the mere fact that a doctor and a patient played role in this part, but also a completely lawful and legitimed ommission of the doctor which resulted into the death of the terminally ill patient is considered as euthanasia.

Unless the precise definition of what only is to be regarded as euthanasie is laid down, the whole discussion on eventual (even partial) decriminalisation of euthanasia is meaningless.
