Abstract
This paper summarizes and comments on the basic points of the EU Court of Justice in Case C 378/09 non transposition of Directive 85/337/EEC. This is a decision against the Czech Republic, the findings show that the CR that within the period prescribed laws and regulations concerning the securing of public access to justice in terms of participation in the infringement proceedings concerning the assessment of certain public and private projects the environment, fulfill the obligations imposed on it under this directive.
