Several comments to the Current Account Contract under the Commercial Code

Abstract

Current account contract as one of the banking contracts is regulated by sections 708 715a of the Commercial Code. The article contents analysis of the current account as a legal institute and several comments to the fundamental provisions as well.

Importance of the Business terms [conditions] as a part of the current account contract is evaluated in various consequences. Another part of the article describes optional provisions of the current account contract and their relevance from the client?s and the bank?s point of the view. There are several comments to the existing law based on the practical experiences of the author.

The conclusions drawn from the analysis have been created in the final part of the work. Majority of them includes proposals to the new legislation with the explicit intent of increasing consumer protection in this area.
