The Status of Long Term Residents in the Czech Law

Abstract

The chapter focuses on the impact of EU law on the Czech national law in the position of third country nationals who live in the Czech Republic as long term residents. Their position is influenced by relevant directives of EU law and also by transposition of those directives into the Czech national law.

One part focuses on a specific problem with transposition which was identified, and analyses the respective practice in the Czech Republic, mainly whether the practice uses the possibility of direct effect of the directive. The author finds out, that the Czech legislation and practice (in the 2010) is not compatible with the relevant part of the EU law.
