Abstract
The article critically describes the finding of the Constitutional Court File No. IV.ÚS 3010/08 of 28.07.2009 where was judicated, that If agrico-operatives were at the end of the restitution process satisfied all claims of entitled persons, and if there remained unused portion (so-called restitution provision), should it also be divided among the beneficiaries.
The problem is: when and by whom restitution provision is to be divided and also problem of unsettled transfor-mation claims statute-barred in this context.
