Legislative developments adjustments criminal liability of legal persons in the Czech Republic, including the new draft law on criminal liability of legal persons and proceedings against them
Abstract
The Criminal Liability of Corporations is indisputably regarded as a contemporary phenomenon, which brings a lot of debatable questions. The Czech Republic has not it provide yet in its legal system, although it is bound by international treaties and the European Union legislation.
The path taken by the new draft on the Criminal Liability of Corporations and proceedings against them takes a place on a platform of the criminal law. The draft sets a range of Corporations to which the Criminal Liability of Corporations does not apply.
Currently, there are two possible options concerning an extent of the criminalization of Corporations. The draft provides a wide range of sanctions into account.
However, it is very difficult to predict, if the draft will pass successfully its way in the legislative process.
