Refugee definition and its interpretation and application in contemporary international law

Publication at Faculty of Law |
2011

Abstract

The dissertation examines the definition of a refugee and its interpretation and application. It is based on the definition which is incorporated in the Convention Relating to the Status of Refugees of 1951.

This convention is still applicable because of the adoption of the Protocol Relating to the Status of Refugees of 1967 even after 60 years. The reasons for which people leave their homes differ from the reasons which states took into account in 1951.

Is there a subsequent shift in the interpretation of the definiton? The author finds out, that the interpretation of the definition is different, but there is no new customary definition in the international law, not even regional customary definition.
