Current questions regarding the treatment of foreign law in judicial and arbitral proceedings

Abstract

The article is trying to point out the positives and negatives of using foreign law, which refer to the conflict rules. Requirement to use foreign law as the law with all of the resulting consequences, however, corresponds to the classical concept of equality laws, which should respect both the judges and arbitrators.
