Abstract

The legal situation encompassing the approved law on Civil Service is hard to believe. There is a law passed by the Parliament in 2002, which never come into effect in its complexity but its effectiveness has been several times postponed and the government recently declared its intention to prepare a completely new law.

This paper argues that such a legal situation is not only peculiar regarding standards of western legal culture but also in the connection with a number of other things, e.g. fight against corruption or desire to improve efficiency and management flexibility of bureaucracy. One cannot await efficiency, stability or integrity form the civil-service system that is based on an improper legal basis without job safety and solid protection against current political influence.
