The obligation to guarantee the complete independence of the national administrative authorities entrusted with supervisory powers over bodies responsible for protection of personal data outside private sector, which is required by Union law, was infringed by Germany. The European Court of Justice justified its ruling by the necessity of coherence of Union-wide protection of data in question, equivalent at both levels of the system - European one and natiponal one.
