Abstract
This paper focuses on the issue of the responsibility in the international law of both the state and also individuals while using the weapons of mass destruction. The issue of the nuclear weapons respectively the weapons of mass destruction is easier to imagine while the weapons are used by the state rather by the individuals.
On the basis of this fact the author has paid her attention to the both actors. Finally, the author briefly analyses the possibility of the punishing of the usage of the weapons of mass destruction at the International Criminal Court and its merits.
