Liability of the Roman Catholic Church for a legal act made contrary to its regulations

Abstract

Article at a theoretical level by binding to debate the issues of Canon Law, Catholic Church against third parties, particularly in connection with church restitution. Relations between the internal regulations of Churches registered by the Ministry of Culture of the Czech Republic and the regulations of the Czech Republic represent the relationship that has not been fully explored yet.

While in the past there was no frequent interest in correlation of these regulations, in connection with church restitutions it becomes topical. The author of the article tries to arrive at the conclusion whether the breach of canonical rules could cause invalidity of a legal act according to the rules of law of the Czech Republic.

The end of the article is not unequivocal because it lacks a decision of the Constitutional Court of the Czech Republic in this explicit matter. However, the author inclines to the conclusion that breach of canonical rules of the Roman Catholic Church may lead to the relative invalidity of a legal act according to the rules of law of the Czech Republic.
