Drugs and Crime. Criminal and Criminological Aspects of Illicit Drug Use.

Abstract

This thesis deals with the issue of drugs and crime. In view of the broad scope of the topic, the author focuses on the criminal law and criminological aspects of the use of drugs; in this context, drugs mean any illicit drugs.

The thesis is arranged into two basic parts, dealing with theory and research respectively.The introduction to the theoretical part provides a general overview of the drug situation in the Czech Republic and Europe using the four cornerstones of drug policy. Summarising the situation in the reduction of both supply and demand, the author interprets data from the areas of prevention, harm reduction, treatment, and the enforcement of criminal (and administrative) law.

In addition, the thesis provides an overview of the development of the legal definitions of the constituent elements of primary drug-related crimes from the period of the Austro-Hungarian Empire until the relevant legal regulations stipulated in Act No. 40/2009 Coll., the Penal Code, as amended. The research part of the thesis contains the analysis of the case files of clients of the Legal Aid Centre project of A.N.O. - the Association of Non-governmental Organisations providing addiction and social services for people at risk of addictive behaviour.
