Advertising in EU competition law

Abstract

This article summarizes rules of advertising in relation to the competition law. The question is whether the advertising is protected by competition law or on the contrary whether it might be considered as a violation of EU law.

The article begins with theoretic differentiation between the competition law and unfair competition. The subsequent chapter analyses if articles 101 and 102 TFEU may apply to business practices in advertising products and services.

The final chapter contains an analysis of unfair competition, in particular misleading and comparative advertising.
