On the right to be heard within a proceedings on review of custody continuation

Abstract

The subject of this article is the question, whether the questioning of the defendant is the compulsory requirement in the procedure concerning the decision on duration of the custody, and whether the absence of such questioning is the essential defect in procedure, which shall result in annulment of the decision concerning the custody and the release of the defendant.
