New mechanisms of fundamental rights protection in the European Union as desirable aim but undesirable means: several notes to the Heidelberg proposal

Abstract

The level of protection of fundamenta rights is generally considered as an important indicator of mature society. Nevertheless we may encounter concerns whether the new mode of protection of already acknowledged fundamental rights will be a means in itself or it will serve to achieve other, in particular political aims.
