The criterion of habitual residence in private international law

Abstract

The book deals with the concept of habitual residence, one of the basic institutions of private international law. The concept of habitual residence are increasingly emerging in modern sources of private international law, as in the conflict of laws rules, and the rules of international civil procedural law.

It is the busiest connecting factor in international treaties, the EU regulations and recently in the Czech rekodifikované regulate international private law. With a few exceptions, however, there's a clear definition of its interpretation and definition are thus left to the case law and the literature.
