The Work of the International Law Commission in 2013

Abstrakt

The article deals with the burden of proof in EU law and explains how the strict application of this rule may have a negative impact on the functioning of human rights law. Recent cases in the USA and on the EU law level show that the burden-of-proof-rule may cause absurd situations.
