Changes in the general system for the recognition and enforcement of judgments in civil cases in the EU

Abstract

The revised Brussels I Regulation (Regulation no. 1215/2012) will simplify the general system of recognition and enforcement of judgments in civil matters among the EU Member States. The principal amendment is the removal of the procedure on declaration of enforceability of a judgement (exequatur) and the shift of the control mechanisms into the enforcement phase.

The new regime is similar to the traditional Czech internal rules on recognition and enforcement of foreign judgements in patrimonial matters.
