Relation between environment and property rights in the light of the principle of the highest value

Abstract

Generally speaking, we can observe that all states around the World protect their own legal, social, religious and other values. Many complicated links and relations have been developed during the history of law, respectively mankind.

However, these traditional connections have been heavily affected by a newly arising value with completely different features, i.e. environment and its components. Nowadays, the environment and its favourable state plays a significant role in today's discusssion about the nature of law.

Anyway, the most visible issue represents a conflict/collision between the environment and property rights. In this regard, legal orders must set up a reasonable and fair balance in order to meet the requirements of the sustainable development.

Nevertheless, the process of finding the solution is still at the beginning.
