Abstract
The case law of the European Court of Human rights influences the area of the protection of personal rights. In the case law there are institutes from the Common law applied and therefore are entering the continental legal system and the Czech republic.
I tis necessary to discuss the historical background and the use of these instruments to be able to recognize its value, the protection of privacy is of high importance.
