Abstract
The exemption of the ISP liability providing discussion board or websites is secured on condition that the ISP upon obtaining actual knowledge or awareness of illegal content acts expeditiously to remove or to disable access to the content. The Czech courts clarified the notification requirements but in determination of the reasonable period for taking the post down if the content is clearly and manifestly illegal and the assessment of the remedies did not decide in compliance with Directive.
