Criminal Liability of Corporations for Crimes Against Human Life and Health

Abstract

This article deals with the instute of corporate criminal liability, more specificly corporate criminal liability for the crimes against life and health of the person. According to the current law in the Czech republic, legal persons cannot be held criminally responsible for this kind of crimes.

Using the method of comparison, article identifies legal trends involving corporate criminal liability. On the basis of identified legal trends, the article reviews corporate criminal liability in the Czech republic and suggests its future legal form.

The first section of the article examines corporate criminal liability in the common law countries, specificly in the United Kingdom and the USA. In the next section, corporate criminal liability in the chosen European countries is being compared.

Third and the last section deals with the corporate criminal liability in the Czech republic in the past, present, as well as in the future.
