Abstract

This is the second part of an extensive study on premeditation and aforethought as aggravating circumstances in murder; it focuses on the criticism of these elements in the classification of intentional killing in terms of both legal theory and judicial practice. The texts comments on large case law in foreign jurisdictions and analyzes the changes in the understanding of the concept of premeditation in German, Austrian, Czech and Slovak criminal law.
