Moral delicts in marriage. Legal theory and judicial practice II. Incest and bigamy

Publication |
2009

Abstract

This paper represents the second part of the study focused on the issue of three moral delicts - adultery, incest and bigamy - in the post-medieval/early modern period. It is a continuation of the first paper and brings a complete analysis of the latter two studied delicts - incest and bigamy.

It follows the same structure of argument as in the case of paper on adultery. Both delicts are analysed among other things on the basis of the study of early modern legislative texts and have the so-called "blood books" or "black books" from Bohemia and Moravia between the 16th and 18th century.
