Abstract

This article reflects on the perspective of new czech health law legislation more concrete possibilities of the substitute decision making. In The Czech Republic exists this possibility from 1st October 2001, but very rarely used.

From april 2012 is there more concrete regulation, which can bring more problems. We are looking for resolving the useful requirements for interpretation of advance directive or living will.

We see this solution in nomination of proxy decision maker, which can be a partner of a doctor in interpretation of the patient's text. Second niveau of our article is question of christian ethical values.

In these context we see as very advanced a german solution of the Deutsche Bischofkonferenz and Rat der Evangelische Kirche in Deutschland in their text Christliche Patientenvorsorge. Here they connet the patient's text and nomination of the proxydecision ma-ker and imbed into it a christian ethical values.
