This article intends to outline the development and to draw attention to certain problematic provision of the existing law. Article 5 of the Constitution of the Czech Republic 1992 provided that the political system of the republic is based on free and voluntary creation of political parties and by their free competition, while respectingbasic democratic principles and refusing violence as a means of enforcing their interest.
Legal standing of political parties in the territory of the republic which was part of the Austrian monarchy, than of independent unitary Czechoslovakia followed by the Czechoslovak federation (and also of Nazi German Empire) has been developing and changin in various directions in the last 150 years; however special legislation on political missing until the beginning of 1990.
