Abstract
This article focuses on one of the questions that at first sight, unambiguous and fast response and, as will be shown below, just way easy solution may not be correct. Specifically, I will discuss whether and, if possible changes brought by the new Civil Code and recodification of private law in the termination of employment in relation to the time limit for bringing an action for declaratory termination of employment.
Thus, attention will focus on the relationship (especially) Labor Code § 72 and § 647 and 652 of the Civil Code 5.
