Abstract

Analysis of Directive 98/5 on facilitating the continuous practice of the profession of lawyer in a Member State other than that in which the qualification was obtained. The fact that a national of a Member State decided to obtain a professional qualification in a Member State other than their State of residence there in order to take advantage of more favorable legislation does not in itself suffice to constitute an abuse of freedom of movement.
