Abstract
Article deals with European Union topic, more precisely with debates focused on nature and character of constitutional quality of EU. It presents differences between "simple" state establishment and "derive" establishment of EU.
Author suggests that considering EU just in terms of state sovereignty is inaccurate, and shows his own attitude to EU's constitutionality debate. Additionally, he offers starting point to further EU's constitutionality discussions.
