Abstract

The monograph "Function and position of legal liability in the recent legal order" provides a comprehensive set of papers dealing with legal liability from several perspectives: from a general theoretical point of view (function and position of liability), in relation to the recodification of private law, in relation to specific legal institutes (private law liability, damages, corporate criminal liability, pre-contractual liability, wrongful life, due managerial care, liability of football referees or liability of the church), in relation to some foreign legal orders (such as those of Belgium, France, Germany, the Netherlands, Austria, Switzerland, the USA or United Kingdom) and, last but not least, in relation to selected non-legal normative systems (e.g. moral normative system, normative systems of sport or the church). The publication is divided into a general and a special part.

The general part, containing five chapters, explores the conceptual changes of legal liability mainly in relation to the recodification of private law; the four chapters of the special part primarily look into selected legal institutes.
