Abstract
The paper examines the assessment of health fitness to work of employees. The article draws attention to differing legal opinions, contained in recent case law, regarding the legal nature of medical report, and particularly the question whether a civil court is bound by the content of the medical report.
The author supports the opinion that recent views, according to which the medical report shall not be acknowledged as correct by civil courts, are incorrect.
