Abstract

The rule of proportionateness is one of the rules carrying out the idea of justice in private law. This rule finds its expression primarily in legislation of abnormal harm and usury.

This and also the exact harmonisation with rule of professionalism are dealed in the article. In article's closing there is added a comparison between Czech legislation and Austrian, German and English legislation.
