Abstract

This chapter shows points of contact and parallels of legal culture expressed in the Austrian General Civil Code (ABGB) with educational efforts of popular enlightenment. In the 'popular enlightenment' concept people are not equal as far as their civil rights are concerned but everyone can win equal honour, even if one is subject to the nobility and state.

In conformity with the Josephine legal culture and the ensuing Austrian General Civil Code (ABGB), all people are guaranteed, in addition, equality in private law. The second part of the text focuses on legal norms and judicial organisation in a given period, and the concluding segment treats legal practice, taking into account specific demesnes.
