Human rights as an example mandatory rules of general international law

Abstract

Establishment and enforcement of jus cogens runs parallel with the development of international human rights law at the universal and regional level. Not only that, most still recognized mandatory rules concerning the protection of fundamental human rights, but precisely in this area shows the greatest potential for expansion of the material and content of mandatory rules.

The key role in the promotion and development of mandatory standards plays a jurisprudence of international judicial bodies, not only MSD and the ECHR, but also Interamerického Court of Human Rights.
