Concurrent Performance of Top Positions in Capital Companies (legal status for publication September 1, 2014)
Abstract
This publication deals with a very current issue of the concurrence of a statutory authority of company or of its member with a contract of employment with the statutory, in which is his occupation defined similarly to the activities which could be included in the concept of business management. This text provides a detailed legal analysis of the issue in both theoretical and practical terms and offers a possible solution including the recommended procedure for companies after 1 January 2014.
The authors work with a number of judgments of the Czech courts and a legal comparison with the adjustment of this topic in foreign jurisdictions is also involved. This book also analyzes connection of this issue to criminal liability, including criminal liability of legal persons.
