Hospital discharge of new born babies before expiration of 72 hours from birth

Abstract

Since December 2013 there has been released a new Methodical manual on hospital discharge of new born babies in the Bulletin of Ministry of Health. The article deals with this manual from the legal point of view, lists related law and court findings.

In particular focuses on the conditions for stay at hospital without consent. Crucial issue for an early discharge from hospital is to state whether there is a need for urgent care.

In case there is no need for urgent care the refusal of treatment could be signed by the person with parental responsibility. As there could be a connection between hospital discharge and social and legal protection of children, the article also refers to the basic conditions when it is necessary to contact authority for social and legal protection of children or Police of the Czech Republic.

The manual does not produce any new situation, it is just more detailed. The manual remains to be only guidance.

In every single case particular conditions for hospital discharge have to be taken into account.
