Czech Delictual Liability in the Field of Biodiversity Protection - Several Aspects de lege lata and de lege ferenda

Abstract

The article deals with one of the most important and current issue of the recent national as well as EU environmental law, which is the delictual environmental liability as a tool of enforcement of the environmental protection. Environmental law may be subdivided into two basic kinds of environmental liability - liability for environmental loss and delictual liability.

Liability for environmental loss is subdivided for civil liability for damage as well as public liability for ecological harm. A special case is responsible for the historical damage.

Delictual liability is subdivided into criminal liability and administrative liability. In this paper, the author focuses on the analysis of current Czech delictual law in the field of protection of the biodiversity and considers several aspects of this issue de lege ferenda.
