Concurence of Delictual Liability and Liability for Environmental Harm in Waste Management Regulation

Abstract

This article discusses the scope of the Czech environmental legislation applicable to liability for environmental harm caused by illegal treatment of waste. It covers specific legislation implementing Environmental Liability Directive, Waste Management Legislation as well as specific oriented legislation for the protection of water, soil, forest and nature.

Finally it stresses some aspects of administrative and criminal offences liability regime that can be used as incentives for voluntary remedy of environmental harm on the side of the polluter.
