Abstrakt
The thesis deals with the tort and contract law in general with respect to the adoption of a new contract typ ""Behandlungsvertrag"" to the German civil code. The thesis analysis the effects of the new contract type to the current legal relationships and describes how a damage may be claimed simultaneously according to the tort and contract law.
Attention is paid to the newly adopted obligations to the clear oral explanation of the medical procedure and intelligibility of that explanation.
