Abstrakt
This thesis deals in two parts with the intersection of the justice (fairness) and a fair trial. The first analytical part is dedicated to the analysis of the decisions of the Slovak and Czech Constitutional Court, in which they handle about the interpretation which is in extreme contradiction to the principles of justice, and thus about breach of the right to a fair trial.
The character of the second part is philosophical and it deals with reasons and consequences following from the first part.
