Abstract
Evidence is only one kind of grounds for the administrative decision issuance. Generally, the evidence procedure may not be included in each administrative proceeding.
Different situation for particular (sub)types of administrative proceedings.The legislation in force does not reflect this fact enough. The problem of overuse of the provisions on the evidence procedure.
The problem of the lack of provisions on the formal implementation of other grounds, especially facts known to the administrative body in its official capacity. The consideration de lege ferenda.
