Limitation of liability of bodies to address the crisis in the European banking sector and its possible misuse

Abstract
At present the crisis in progress not only of banking sector has resulted in many legislative initiatives in the area of the financial market law. It concerns an effort to eliminate or at least minimize probability of a serious disruption of the financial sector and, in particular, confidence in banking sector as such.
In the European Union there therefore arise acts, which ought to ""arm"" authorities of crisis management with suitable powers and tools on one hand and on the other hand then to restrict the liability of such acting. The aim of this article is to describe briefly and assess the stated initiatives in the area of liability limitation and consider possibilities of its misuse
