Abstract
The paper first analyzes regulatory developments of punishment house arrest since the introduction of the Criminal Code no. 40/2009 S., to this day. The autor describes the current state of storage of this penalty in the Czech Republic with an emphasis on the development of the number of sentences imposed over the past five years.
Based on the statistical data defines the basic problems of house arrest and trying to find the cause of a small amount of the penalties imposed. Statistical data confronts them with her own questionnaire survey, with was conducted between juges in 2010, the first year of the existence of house arrest, and then again in 2015.
It focuses not only on the issue of the lack of an electronic monitoring systém, but also the question of the suitability of offenders for punishment house arrest.
