Compulsory representation of a party to the adversary proceedings and its perspectives

Abstract

The party to a case is de lege lata not obliged to be represented by a lawyer during the proceedings. Compulsory representation before court is applied only in hearing before the court dealing with an appellate review.

The introduction of compulsory representation by a lawyer seems as required particularly in the civil adversary proceedings. The article considers the opportunities of de lege ferenda in the lawyer's proceedings with the goal of noting the benefits in particular, but also the drawbacks of this solution.
