State of Exception And State of Emergency : What Is the Difference Between Them and Under What Circumstances Can They Be Regarded as Legitimate Forms of Extraordinary Power?

Abstract

In this lecture, I expand on the difference between the state of emergency and state of exception against the background of Schmitt's reflections on the difference between commissarial and sovereign dictatorship. The aim is to show under what circumstances can these extraordinary forms of exercise of power be regarded as justifiable and why.
