The Article has shown that the traditional theory of non-succession in the field of State responsibility for internationally wrongful acts no longer corresponds to the current state of international law. Starting with a survey of doctrinal views, the Article addressed two main questions.
First, whether there is a rule of international law excluding, in cases of State succession, any transfer of responsibility to a successor State. Second, whether a successor State can present a claim to reparation on behalf of its nationals for damage suffered at the time when they had the nationality of a predecessor State.
