Abstract

This text briefly reports on the basic information concerning the decision of the European Court of Human Rights in case Hanzelkovi v. the Czech Republic of 11. 12. 2014. The decision deals with the issue of the conditions for the state authorities if and when they are allowed to force mother to return her new-born baby to the hospital after she had wilfully left it with her new-born baby.

The text focuses on the facts of the case, on the remarks of the European Court of Human Rights during its consideration, the findings and on the minority opinion of the judges who dissented with the decision.
