Abstrakt
This article deals with the judicial protection of rights in a state governed by the rule of law and its role in the time and it analysis the requirements imposed by the new codification of private law on civil procedure. Finally, this article sums up (on the basis of previous analyses) the considerations on future new codofication of civil procedure, both institutional and procedural.
