State aid and the fundamental human rights: proceedings concernings state aid and the fair trial right

Abstract

The article analyses the very important question whether the acceptant of a state aid has an adequate procedural rights which would correspond to his position. The result of the analysis is that regulation providing for proceedings concerning the state aid is contradicting with the European Convention on Human Rights and the Charter on Fundamental Human Rights of EU.

Therefore a proposal is made to grant the acceptant of a state aid position proceedings party.
